Terms of Service

These Terms of Service ("Terms") govern your access to and use of The Privateer, a service operated by Privateer Technologies LLC ("we," "us," "Privateer"). By creating an account, signing in, or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. What the service does

The Privateer watches shipments you ask us to track — by the carrier tracking numbers you provide — and detects carrier service failures (such as late deliveries) that may make a shipment eligible for a refund or service-guarantee credit from the carrier. The service flags these "catches" and, on a paid plan, prepares a claim packet you can use to request the refund directly from the carrier.

We are not a carrier, and we are not affiliated with, endorsed by, or acting on behalf of UPS, DHL, or any other carrier. Carrier names are used only to identify shipments and their published service terms.

2. We prepare claims; you file them

The Privateer identifies potentially refundable shipments and assembles the information needed to request a refund. You submit the claim to the carrier, and the carrier alone decides whether to grant it. We do not file claims on your behalf, do not receive funds on your behalf, and do not take any percentage of any refund — what you recover from the carrier is entirely yours.

3. No guarantee of eligibility or outcome

Refund eligibility depends on the carrier's own service terms, exceptions (such as weather, customs, or force-majeure delays), and filing deadlines, all of which the carrier controls and may change. We make a good-faith effort to identify eligible shipments and applicable filing windows, but:

4. Your account and eligibility

You must be at least 18 and able to form a binding contract. We use passwordless sign-in: you provide an email address and we send a one-time sign-in link. You are responsible for keeping access to that email account secure and for all activity under your account. Notify us promptly at support@theprivateer.ai if you believe your account has been accessed without authorization.

You agree to provide tracking numbers and shipment information that you are authorized to submit, and not to track shipments that are not yours or that you have no legitimate interest in.

5. Plans, trials, and billing

The service offers a free tier that flags catches and a paid subscription that unlocks claim packets. New accounts include a 30-day trial. Paid plans are billed monthly in advance through our payment processor, Stripe. Plan tiers are determined by the number of shipments under watch on your account.

6. Acceptable use

You agree not to: misuse or attempt to disrupt the service; access accounts or data that are not yours; probe, scan, or test the security of the service without our written permission; use the service to send unsolicited messages or to submit tracking numbers you are not entitled to track; or use automated means to overload the sign-in or onboarding flows.

7. Third-party services

The service relies on third parties including carrier tracking APIs (UPS, DHL), our payment processor (Stripe), and our email provider (Resend). Your use of the service is also subject to those providers' terms where applicable. We are not responsible for third-party outages, data, or decisions (including a carrier's decision on any claim).

8. Intellectual property

The service, including its software, content, and the format of the claim packets we generate, is owned by us and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the service for its intended purpose. The shipment data and tracking numbers you provide remain yours.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY CATCH, AMOUNT, OR DEADLINE WE DISPLAY IS ACCURATE OR COMPLETE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST REFUNDS, LOST PROFITS, OR MISSED FILING DEADLINES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your misuse of the service, your violation of these Terms, or your submission of tracking information you were not entitled to use.

12. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the service. On termination, your right to use the service ends; sections that by their nature should survive (disclaimers, limitation of liability, indemnification) survive.

13. Changes to these Terms

We may update these Terms. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Continued use after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules, and you and we submit to the courts located there, except where applicable law provides otherwise.
